THIS DOCUMENT FORMS AN INTEGRAL PART OF THE GENERAL TERMS AND CONDITIONS OF USE OF FOR ME AND ESTABLISHES THE GUIDELINES AND CONDITIONS UNDER WHICH THE RELATIONSHIP BETWEEN FOR ME, THE BRANDS AND THE USERS WHO CARRY OUT PRODUCT CONTENT CREATOR CAMPAIGNS WILL BE GOVERNED, IN ADDITION TO THE USE OF THE PLATFORM.

BY ACCEPTING THESE TERMS AND CONDITIONS, THE USER EXPRESSLY ACCEPTS THE GENERAL TERMS AND CONDITIONS AND ITS PRIVACY POLICY.

These terms and conditions (the “Terms and Conditions for Content Creators”) establish the guidelines and conditions that will govern the activity and relationship between (i) those persons who register to carry out campaigns and/or content creation for various products, whether through the Platform or any other channel or medium provided by For me (the “User” or “Content Creator”); (ii) the brands that own the goods or products whose campaign and/or review is carried out by a User (the “Brands”); and (iii) For Me Tips S.A. de C.V. (hereinafter, “For_me” or the “Company”) when Users register as Content Creators to be part of the For me creator community through https://www.formetips.com/creadores/, apply to a specific campaign and, as a result, have been admitted/selected by For_me in such capacity with respect to any of the Brands with which the Company has perfected an agreement. The Terms and Conditions will apply to all activities and interactions between the Parties, regardless of the channel or medium through which they are carried out, and will not be limited to the use of the Platform. The Users, Brands and Company will be referred to jointly as the “Parties” and each of them individually as the “Party.”

All Users or Content Creators who wish to link with For me, having perfected an agreement with the Company, and/or access and/or use the For_me Platform, must do so subject to these Terms and Conditions for Content Creators, as well as the other General Terms and Conditions thereof, together with all other policies and principles that govern the Platform and that are understood to be incorporated herein by reference.

ANY USER WHO DOES NOT ACCEPT THESE TERMS AND CONDITIONS, WHICH HAVE A MANDATORY AND BINDING CHARACTER, MAY NOT LINK WITH FOR ME FOR THESE PURPOSES, HOLD THE QUALITY OF CONTENT CREATOR AND MUST REFRAIN FROM USING AND AVAILING THEMSELVES OF THE PLATFORM OR ANY OTHER CHANNEL PROVIDED BY THE COMPANY IN SAID CONTENT CREATOR CAPACITY. NOTWITHSTANDING THE FOREGOING, THEY MAY ADAPT TO THE GENERAL TERMS AND CONDITIONS OF USE IN THE EVENT THEY WISH TO CONTINUE AS A USER IN ANOTHER CAPACITY.

The Content Creator must read, understand and accept all the conditions established in these Terms and Conditions for Content Creators, the General Terms and Conditions of Use and the Privacy Policies, as well as in the other documents incorporated therein by reference, since the mere request to be incorporated as a Content Creator will imply and/or presume that they read, understood and accepted them in full compliance.

CREATOR COMMITMENTS

By accepting these terms and conditions and participating in any campaign, the Creator declares and commits to:

1. Availability: Maintain minimum availability during the period specified in each campaign form (which may vary according to the particular campaign) for the creation of requested content.
2. Publication Commitment: Publish the requested content including the corresponding hashtag and send the corresponding evidence to For_Me within a maximum period of 10 (ten) calendar days from the date of receipt of the product.
3. Evaluation Collaboration: Complete surveys about products that are requested as part of the campaign evaluation process.

Failure to comply with these commitments may result in exclusion from future campaigns and/or legal actions that correspond according to current legislation.

1 – Capacity

Only persons of legal age who have legal capacity to contract and comply with the guidelines provided herein may be Content Creators. Persons who do not have such capacity, minors, or For_me Users and/or Content Creators who have been temporarily suspended or permanently disabled by the Company may not be Content Creators.

2 – Registration

To request the status of Content Creators within the Platform, it is mandatory to complete the registration form sent by For_me in all its fields with valid and verifiable data. The interested party must complete it with their personal information in an exact, precise and truthful manner (the “Personal Data”), including especially those data and information linked to the social networks that they will use to promote and advertise products in accordance with the provisions of this document (not including passwords), and assumes the commitment to update the Personal Data as necessary. Once the respective form is completed, the User may apply to current campaigns and if selected by For_me according to the parameters set by the Brand for the campaign in question (age range, geographic location, type of products, skin type, consumption habits, etc.) will be duly notified, all at the exclusive discretion of For_me. Upon receiving the confirmation notification, the interested party assumes the status of Content Creator, having accepted these Terms and Conditions for Content Creators at the time of requesting their registration.

Notwithstanding the public nature thereof, Content Creators expressly authorize For_me to share their usernames from any social network, including, but not limited to, Instagram and TikTok.

The personal data entered in the registration form will have the character of a Sworn Statement, which is why the Content Creator will be the sole and exclusive responsible for their veracity and completeness and, consequently, is obliged to keep For_me completely harmless from any claim and/or action that takes place by reason of or on the occasion of the falsity or omission of said Personal Data.

Once the status of Content Creator is acquired, they will access their personal account (the “Account”) by entering their username and chosen personal security password (the “Security Password”). The Content Creator is obliged to maintain the confidentiality of their Security Password.

For_me reserves the right to reject any admission request or to cancel a previously accepted request, without being obliged to communicate or expose the reasons for its decision and without this generating any right to compensation or reimbursement.

3 – Modifications of Terms and Conditions for Content Creators

For_me may modify the Terms and Conditions for Content Creators, the General Terms and Conditions of Use and its Privacy Policy at any time by making the modified terms public on its Website or on the Platform. All modified terms will take effect from the date of their publication. This, without prejudice to the fact that such modifications may be communicated through the For_me Account or by any other means. Any User who does not agree with the modifications made by For_me to the Terms and Conditions for Content Creators may desist from the status of Content Creator and request the cancellation of the Account.

The use of the Platform and the Website subsequent to the publication and/or notification of the modifications made implies acceptance of these updated Terms and Conditions for Content Creators from For_me.

4 – Actions

4.1. Campaign Regime

In the framework of marketing their goods or products, Brands are interested in obtaining Content Creators, comments, opinions, ratings, graphic, visual and audiovisual content and reviews from them for commercial and advertising purposes, for which they carry out various campaigns (the “Campaigns”).

For its part, For_me is the owner of a Platform that allows Brands to launch different Campaigns for goods or products of their ownership so that they can be tested, tested, rated and reviewed by Users; and allows the latter to make a review of them and/or find opinions about their favorite products and new launches.

By virtue thereof, when launching their Campaigns, Brands will establish the good or product to be reviewed, the objectives, age range, geographic location, type of products, skin type, consumption habits, among other criteria.

Once a Campaign is in effect, the User already registered as a Content Creator according to what is stated in 1 and 2, may apply to it and, if selected by For_me, according to the criteria established by the Brand for the Campaign, will be contacted by For_me to coordinate the delivery of the good or product with respect to which they must create content.

The same Content Creator may apply/apply to various Campaigns at the same time, but the selection process will depend on the criteria set by the Brands for each Campaign, so the Content Creator accepts that they may not be selected for some or all of the Campaigns to which they applied without this granting them the right to compensation and/or any claim against For_me.

Each Campaign is different so the User must renew their registration and application for each one. This means that registration as a Content Creator and application to a Campaign or selection for one of them will not imply registration, application, or selection for other current Campaigns.

Upon receiving the product, the Content Creator must make their review through the generation of content that they must then publish through one of the available alternatives. The quantity and regularity of their publications will be at the discretion of the Content Creator in accordance with their own interests, under the modalities they deem best and always respecting the criteria and guidelines set by the Brand organizing the Campaign.

The Content Creator will have the freedom to express their own opinion about the product, whether positive or negative, but always within a framework of respect towards the Company, the Brand and third parties. Regarding those publications that are made on the For_me Platform and that do not comply with these parameters, they may be deleted and the Content Creator may be suspended temporarily or permanently from acting as such, all without generating any right to claim and/or compensation in their favor.

4.2. Publications

Publications may include descriptive texts, graphics, photographs and other content and conditions pertinent to the promotion of the product, provided they do not violate any provision of this agreement or other For_me or Brand policies/guidelines.

The Content Creator commits to:

• Not share content with themes and lifestyles that romanticize and promote weapons, alcohol, tobacco and drugs.
• Not share content publicly with nudity or explicit sexual activity.
• Not share statements on sensitive topics such as Racism, Discrimination, Xenophobia, LGBTQ+phobia, etc.
• Not share violent/dangerous content.
• Not possess any public scandal that could negatively affect the perception of their publications.
• Not share content openly supporting any political party.
• Not speak against brands within the For_me community.
• Not abuse their influence power.
• Maintain professional and ethical conduct in all their collaborations.

For_me may remove the Content Creator status from the User if the publication of images, photographs, videos or texts damages the Company’s image or harms the Brands that promote their products through the Platform and/or third parties.

All publications must indicate that comments and opinions are part of a promotional campaign. Failure to comply with this obligation will authorize For_me to remove the content from its Platform and/or require the User to remove or rectify the content generated and published on personal social networks or third-party sites.

For_me respects the intellectual property and copyright of third parties, therefore it requires Content Creators to do the same. For this reason, all content generated and published by Users must be 100% original. Theft or plagiarism of images, audios, videos and/or any other content will not be tolerated. In the event that Content Creators violate any type of intellectual property or copyright of a third party, the Content Creator becomes exclusively and personally responsible for the damages that may correspond and, likewise, is obliged to keep For_me, its affiliates, directors, employees, agents and/or representatives harmless from any damage, expense, cost, costs (including legal fees that For_me may incur to defend itself against such claims) that are derived from claims, demands and/or actions of any nature initiated by any third party due to non-compliance by Content Creators with this section.

The Content Creator declares and guarantees that, in case of participation of minors in the content or publications created within the framework of this agreement, they have all the necessary authorizations from the legal representatives of said minors for their participation. The Content Creator commits to keep For_me, its affiliates, directors, employees and agents harmless from any claim, demand, legal action or liability that could arise as a consequence of the participation of minors in the content or publications, including, but not limited to, claims for violation of image rights, privacy, or any other legally protected right. This indemnification will include reasonable legal fees that For_me may incur to defend itself against such claims.

The relationship established with the Content Creator according to these Terms and Conditions for Content Creators has an essentially personal character, since they were selected for certain personal qualities and/or commercial criteria that make them irreplaceable. That is why the Content Creator is obliged to carry out the publications by themselves, being prohibited from publishing content in which third parties other than the Content Creator appear, subcontracting third parties for content generation and/or publication on sites/social networks other than those provided for each Campaign.

Publications must be made by the means and on the sites/social networks provided by the Campaign and within the deadlines provided by each one. Failure to publish content in a timely manner will result in the cancellation of the Content Creator from the “Content Creators Club” and the impossibility of the latter to apply and be selected again for future Campaigns, which will not generate any right to claim and/or compensation in favor of the sanctioned Content Creator.

The Content Creator is obliged to keep the publication and/or content generated within the framework of the Campaign publicly visible, with the hashtags and disclosures of the corresponding Campaign, for a period of at least ninety (90) days counted from the first publication they make.

4.3. Remunerated Content

For_me may, at its sole discretion and voluntarily, offer certain selected Content Creators, based on and/or based on the quality of content and their performance, economic compensation for content generation (“Remunerated Content”). The selection will be determined exclusively by For_me, without this constituting any obligation for future payment for other content and/or continuity or participation in similar programs.

The participation of the Content Creator in Remunerated Content programs is absolutely voluntary.

Participation will be subject to specific terms and conditions established through additional documents that must be accepted by the Content Creator.

To receive compensation, the selected Content Creator must issue a valid invoice or legally acceptable equivalent tax document in their local jurisdiction. The amount of compensation will be determined in local currency, calculated at the exchange rate in effect on the day of payment.

In the event that the Content Creator cannot issue an invoice or equivalent tax document, For_me may, at its sole discretion, make the compensation through a “Gift Card” or any other equivalent means, without this generating any right to additional claims or compensation by the Content Creator. For_me will not be responsible to the Content Creator for delays, limitations or impossibility of use of a Gift Card or alternative payment method delivered, derived from circumstances beyond its control.

The Content Creator is the sole and exclusive responsible for complying with tax and/or tax obligations applicable to the amount received. For_me will not assume any responsibility for taxes, withholdings or any other tax obligation linked to the payment made.

What is provided in Clause 5 regarding the assignment of intellectual property and copyright rights regarding the generated content will be applicable to Remunerated Content, as well as the authorization to use the image, voice and any other similarity that allows identifying the Content Creator.

Participation in the Remunerated Content program does not grant exclusivity rights nor guarantees selection for future compensations.

By participating in the Remunerated Content program and receiving the corresponding payment, the Content Creator expressly accepts the conditions established in this clause, the Terms and Conditions for Content Creators, as well as the additional specific terms and conditions that may be applicable, waiving any right or claim related to content.

4.4. Content Selected for Promotion

Brands, through For_me, may select content created by Content Creators for Campaigns in order to invest in their promotion using advertising such as Spark Ads (“Content Selected for Promotion”). In the event that a Brand selects content, For_me will inform the corresponding Content Creator about the selection and consult whether they agree with the initiative.

If the Content Creator of the Content Selected for Promotion accepts:

(i) For_me will coordinate between the Content Creator and the Brand the investment in advertising to amplify the reach of the Content Selected for Promotion.

(ii) For_me will deliver to the Content Creator a gift card for a value ranging between USD 100 and USD 300, to be used as agreed.

(iii) For_me and the Content Creator will agree on the period during which the Brand will make the advertising investment and the type of investment.

What is provided in Clause 5 below regarding the assignment of intellectual property and copyright rights over the generated content and the authorization to use the image, voice and any other similarity that allows identifying the Content Creator will be applicable to Content Selected for Promotion.

The Content Creator acknowledges that the selection of Contents for Promotion is discretionary by the Brand and that neither the Brand nor For_me are obligated to invest in advertising for content promotion, nor to grant a gift card.

4.5. For Me TOP 5 Creators Program

Content Creators who actively participate in For_me campaigns will be eligible for the “For Me TOP 5 Creators Program,” where they will have the opportunity to be recognized and rewarded for the quality and impact of their content. At the close of each campaign in which the Content Creator has participated, For_me will select the five (5) best Content Creators, who will receive economic compensation according to the performance of the content created.

To access the possibility of monetization, Content Creators must have previously complied with the basic requirements of reviews and/or badges established for the corresponding campaign.

For_me will evaluate the following criteria to select the TOP 5 Creators:

1. Content Creator Performance
2. Quality of content created
3. Compliance with campaign guide
4. Value contribution of content created
5. Reach in its different schemes
6. Engagement rate
7. Brandformance (brand results)
8. Amount of UGC (User Generated Content)

5 – Intellectual Property. Content Assignment. Content Ownership. Authorization of Use of Image. Consent.

The Content Creator may not use the trademarks, commercial notices, copyrights and other intellectual property rights that are the property of For_me and/or the Brands, without prior written authorization from For_me, and only in the manner instructed by For_me and/or the Brand and for the purposes of these Terms and Conditions for Content Creator.

Likewise, the Content Creator will completely refrain from requesting and/or processing on their own behalf and/or on behalf of third parties, the registration of any trademark, commercial notice, copyright and other intellectual property rights, equal or similar to those owned by For_me and/or the Brand.

The Content Creator acknowledges, accepts and expressly declares that when requesting their registration on the Platform as a Content Creator and publishing content on any of the available means for it (Brand website, retailer website, on the For_me Platform, on User’s personal social networks and/or any medium that may be established in the future), they irrevocably, worldwide, free and perpetually assign in favor of For_me, all intellectual property and copyright rights over all content generated by the Content Creator under this agreement and within the framework of the Campaign for which they applied and were selected. The Content Creator acknowledges, accepts and expressly declares that all intellectual property, copyright and any other rights that may correspond to all content generated, produced and/or developed and/or publication made by the Content Creator, under the validity of this agreement and within the framework of the Campaign, by any means or medium, will be the exclusive property of For_me and/or the person to whom it decides to assign them, with the Content Creator waiving to invoke, claim and/or intend the registration in their favor of any property, copyright, intellectual or any other type of right over them.

By virtue of what is stated in this clause, For_me will be fully empowered and will hold over the generated content all rights to: (i) disseminate, distribute, reproduce, publish, communicate to the public, edit, modify, adapt, assign, transfer, economically exploit and/or translate; (ii) grant third parties authorization for its use and execution partially or totally; (iii) transmit to third parties the patrimonial rights over them; and (iv) in general, dispose of the contents generated by the Content Creator fully and as owner by any means and under the forms that best suit them.

The Content Creator may not: (i) use and/or copy the works and/or contents object of this agreement, whether in whole or in part, for any third party; (ii) publish, reproduce, exhibit, the works and/or contents object of this agreement, in a manner different from that provided in this agreement and for the purposes thereof, without prior written authorization from For_me; (iii) grant third parties authorization for its use and execution partially or totally; (iv) assign or transmit legally, by any means and/or method, in favor of third parties, the patrimonial rights over them; (v) use with a scope different from this agreement and/or for profit purposes and/or to economically exploit, by any means, jointly or separately, totally or partially, in the country of residence and/or abroad, any work that may have been created in relation to this; and (vi) in general, dispose of the contents fully and as owner in terms of the current legal provisions.

In the event that the content generated by the Content Creator includes their name, image, voice and any similarity that allows identifying them, involving any form of registration that includes recordings, filming, portraits, caricatures or other forms of capture that allow identifying the person, the Content Creator gives their consent and expressly grants For_me and the Brand a worldwide, perpetual and free license/authorization to capture, reproduce and disseminate their image, voice, physical appearance, name, artistic interpretation, performance and/or any similarity that allows identifying them. This authorization allows any of the content in which said name, voice, image, physical appearance of the Content Creator is captured and reproduced to be used, reproduced, disclosed, published, exploited, and/or incorporated for advertising purposes on the internet, applications and/or social networks of For_me and/or the Brand. For_me and/or the Brand will not be obligated to remove any kind of content publication where the image, voice, physical appearance, name, artistic interpretation and/or performance of the Content Creator is reproduced and/or fixed in chronological records or histories. Said consent of the Content Creator is not limited to the capture and reproduction of content and image for the Campaign in question, but may be used by For_me and/or the Brand in any future promotion and/or publication of their products, goods or services whatever the modality of the latter.

Without prejudice to the consent given through their registration on the Platform, you are informed that making publications on your personal social networks in which you “tag” or “mention” the accounts, sites and/or networks of the Brands or For_me and the publication of your reviews on sites, networks and/or platforms of third parties (including but not limited to Brands, For_me and/or retailers) will be understood as a positive act of acceptance and an unequivocal manifestation of will for the capture and reproduction of the content generated and published, and the image and voice included therein, under the guidelines provided in the previous section.

The Content Creator declares and acknowledges that this content assignment and authorization of use of image and voice is made with the purpose of using and/or reproducing them by For_me and/or the Brand for current and future commercial, promotional and/or advertising purposes, by any means or medium.

By virtue of the fact that the content assignment made and the authorization of use of image and voice granted by the Content Creator are free and perpetual, the Content Creator will have no right to demand from For_me and/or the Brand any type of compensation, consideration, price and/or compensation for them, waiving any claim against For_me and/or the Brand in this regard.

In any event, the Content Creator is informed that in those cases where they disagree with the use of their image or wish to cease its use by For_me and/or the Brand, they may revoke said right to use their image, making it known to administracion@formetips.com

In the event that minors participate in the content or publications, the Content Creator declares and guarantees that they possess the necessary right and authority to grant the consent, authorizations and licenses described in the previous sections on behalf of the minor who participates in the content or publications. In this regard, they grant For_me the consent, authorizations and licenses indicated in this clause on behalf and in representation of the minor. Likewise, they commit to keep For_Me, its affiliates, directors, employees and agents harmless from any claim, demand, legal action or liability that could arise as a consequence of the use of the minor’s image in the content or publications, including, but not limited to, claims for violation of image rights, privacy, intellectual property or other legally protected rights. This indemnification will cover reasonable legal fees that For_Me may incur to defend itself against such claims.

6 – Benefits

For their participation in Campaigns and the creation of reviews, critiques, opinions, ratings and/or publications, the Content Creator will have the possibility to test products from global brands that have just been launched to the market or that are part of their favorite products.

Consequently, for their participation in Campaigns, the creation of publications, the assignment of usage rights and in general for all activity developed as a Content Creator, the Content Creator declares and accepts that the only benefit/consideration they will have under any concept will be to keep for themselves the products that are sent to them for the purpose of reviewing and/or rating, irrevocably waiving any claim against For_me and/or the Brands in this regard and obliging themselves to keep them completely harmless for it. Beyond that, the Content Creator will have no right to receive any price, sum of money, compensation, commission, periodic delivery of products and/or any consideration whatsoever.

7 – Information Privacy

To use the Platform and Services offered by For_me, Content Creators must provide certain personal data. Your personal information is processed and stored on servers or magnetic media that maintain high standards of security and protection, both physical and technological.

The Company declares that the Personal Data of the Ambassadors will be used only for the purposes described in these Terms and Conditions for Content Creators, in the General Terms and Conditions of Use of the Platform and according to the Privacy Policies published that you can find at https://www.formetips.com/privacy-policy/.

WE RECOMMEND A CAREFUL READING OF OUR DATA PRIVACY POLICY.

8 – Content Creator Declarations and Warranties. Exclusion of Responsibility

During the last three (3) years prior to their incorporation to For_me, the Content Creator has not been accused of bullying, sexual harassment or legal problems (such as, enumeratively but not limitatively, issues related to taxes, crime, etc.). Likewise, the Content Creator commits to maintain behavior compatible with these conditions while their relationship with For_me lasts.

The Content Creator has not promoted false content that could affect or harm others (for example, on topics related to vaccination, health recommendations, weight loss, false science, etc.).

There is no first-level communication published on any related topic that negatively affects the Content Creator.

The Content Creator does not possess any public scandal during the six (6) months prior to their incorporation to For_me. Likewise, they commit to maintain this conduct during the validity of their relationship with the Company.

In case of falsity, omission or violation of the declarations and warranties provided by the Content Creator, For_me may automatically terminate the relationship with said Content Creator and claim for damages caused.

The different Brands will be those who directly determine the terms and conditions of each Campaign, being exclusively responsible for the existence, quality, quantity, integrity and/or legitimacy and/or any other matter related to the products or services they promote.

In such regard, For_me expressly establishes and Content Creators declare and accept that the Company excludes itself from any type of warranty or implicit or explicit conditions in the products, including all types of responsibility over them, their commerciability, aptitude for their destination, compliance with regulations applicable to their manufacture, production and/or distribution and any other defect or inadequacy in the quality or quantity of products sent, with For_me being foreign to all these circumstances and only making available to Brands and Content Creators a virtual space that allows them to communicate to promote goods and products. Likewise, For_me will not be responsible for damages that the Content Creator may suffer as a consequence of testing the product and/or for the content/publications made by them.

The Brand will be the sole and exclusive responsible for everything related to the promoted product and/or service.

The Content Creator may not impute any responsibility to the Company nor demand payment for lost profits, by virtue of damages resulting from technical difficulties or failures in systems or on the Internet. The Company does not guarantee continuous or uninterrupted access and use of the Platform. The system may eventually not be available due to technical difficulties or Internet failures, or for any other circumstance beyond For_me’s control, in such cases it will try to restore it as quickly as possible without any type of responsibility being attributed to it.

Likewise, Content Creators are informed that For_me will endeavor to maintain the validity of agreements with Brands. Notwithstanding the foregoing, Content Creators declare to know that in absolutely no case does For_me guarantee the permanence of the relationship with Brands and/or the launch of Campaigns on the Platform, such decision and validity of agreements being subject to the sole discretion of For_me.

9 – Relationship. Independence

These Terms and Conditions for Content Creators do not create any partnership, mandate, franchise, advertising, promotion or employment contract between For_me and the Content Creator, who acts autonomously and independently, without any subjection to For_me. The Content Creator acknowledges and accepts that For_me is not part of Brand Campaigns and has no control over: (a) the quality, integrity, legitimacy of advertised products, the veracity or accuracy of announcements that Brands may eventually make (b) the ability of Content Creators to contract or provide services and other functionalities offered or that the Platform may offer in the future.

By virtue thereof, the Content Creator declares to know and accept that they are not and will have no employment relationship with For_me, nor may they claim from the latter the payment and/or compliance with any of the obligations derived from labor, social security, tax and fiscal legislation and other applicable regulations that correspond to each of them. Consequently, Content Creators are obliged to keep For_me, its affiliates, directors, employees, agents and/or representatives completely harmless from any claim arising from and/or related to the aforementioned matters, without limitation of any kind.

10 – Non-Exclusivity

The character of Content Creator of a particular Brand will not imply in favor of the Content Creator the granting of exclusivity of any kind with respect to said Brand, but, on the contrary, the Company will be fully enabled to select one or several Content Creators for the same Brand. The exercise of such faculty by the Company will not accrue in favor of the User any right to compensation or claim of any kind.

Content Creators may make reviews of all products and all Campaigns including Brands that compete with each other.

11 – Cessation of Content Creator Status

The Content Creator may cease in their capacity as such at any time and without need for any other requirement than to stop applying to various campaigns. In such case, the Parties will have nothing to claim.

12 – Jurisdiction and Applicable Law

These Terms and Conditions for Content Creator are governed and interpreted in accordance with the law of the United Mexican States, which will be in force for the determination of the respective rights and obligations of the Parties.

The Parties commit to make their best efforts so that any disagreement or controversy that may arise from the interpretation or execution of these Terms and Conditions for Content Creator, including their nullity or invalidity, be resolved in a climate of good faith, through direct and amicable treatment between their representatives designated for such purpose.

Notwithstanding the foregoing, in the event that the Parties cannot resolve a controversy amicably within thirty (30) days, they will submit to the competent Courts of Mexico City.
